Terms of Use and Conditions

InvincibleYOU DRIFT Assessment

Version 1.1 · Effective Date: 13 July 2026 · Last Updated: 13 July 2026

1. Preamble

These Terms of Use and Conditions (“Terms”) constitute a legally binding agreement between the individual accessing the DRIFT Assessment using an Access Code (“Participant,” “You,” or “Your”) and InvincibleYOU, a product/service operated by Vedanga Solutions Private Limited, including its affiliates, subsidiaries, licensors, technology partners, successors, administrators, and authorized representatives (collectively, “InvincibleYOU,” “Company,” “We,” “Us,” or “Our”).

These Terms govern access to and use of the InvincibleYOU DRIFT Assessment platform located at tools.invincibleyou.world (the “Tools Website”), including the DRIFT organizational and team-level assessments and related assessment functionality. These Terms supplement the applicable InvincibleYOU Terms of Use governing the broader platform. In the event of a conflict, the broader Terms govern matters relating to the general platform, while these Terms govern matters specific to the DRIFT Assessment.

2. Definitions

Access Code: The credential issued for a Participant to access and complete one Assessment submission.

DRIFT Assessment: The organizational and team-level behavioural assessment described in the associated Privacy Policy.

Sponsoring Organization: The employer or client entity that engages InvincibleYOU to administer the assessment and identifies intended Participants.

User Content: Rating responses, demographic selections, and optional free-text responses submitted through the Services.

Platform: The Tools Website and its underlying software, databases, APIs, and integrations.

3. Eligibility

The Services are intended for individuals invited through a Sponsoring Organization and provided with a valid Access Code. By using the Services, the Participant represents that the Participant is legally competent to contract, that information supplied is accurate to the best of the Participant’s knowledge, and that the Access Code belongs to the Participant and has not been obtained or used without authorization.

4. Access via Organization-Sponsored Credentials

Access requires entry of a valid email address and Access Code. No password-based account is created for the Participant.

  • use the Access Code solely for the Participant’s own completion of the Assessment;
  • not share the Access Code with another person;
  • immediately notify InvincibleYOU or the Sponsoring Organization of suspected unauthorized use; and
  • not attempt to bypass the one-submission restriction or otherwise interfere with assessment integrity.

InvincibleYOU may block, invalidate, or refuse an Access Code suspected of fraudulent, duplicate, or unauthorized use.

5. Acceptance, Consent and Assessment Notice

Before commencing the Assessment, Participants are provided with the applicable Privacy Policy, assessment notice, and required terms. Consent for processing that is based on consent is obtained through a clear affirmative action and is not treated as consent merely because the Participant continues to use the Services.

Where separate consent is required for a particular processing purpose, the relevant consent will be presented separately. A Participant who does not provide consent required for the Assessment will not be permitted to proceed with the processing dependent upon that consent.

6. Nature of Services

InvincibleYOU provides a technology-enabled organizational and team-level behavioural assessment tool. The Services include credential verification, demographic data collection for statistical segmentation, Likert-scale rating collection, optional open-ended feedback, statistical aggregation, and organizational-level reporting.

DRIFT scoring uses statistical aggregation methodologies and does not use artificial intelligence or automated profiling to interpret an individual Participant’s DRIFT score.

7. Acceptable Use Obligations

  • submit false, misleading, or bad-faith responses;
  • attempt to complete the Assessment more than once or circumvent the Access Code restrictions;
  • attempt unauthorized access to the Platform, APIs, databases, or other systems;
  • interfere with the integrity, security, or performance of the Platform; or
  • reverse engineer, scrape, copy, or commercially exploit the Platform without authorization.

InvincibleYOU may investigate suspected violations and invalidate submissions or Access Codes obtained through prohibited conduct.

8. User Content and License Rights

By submitting responses through the Services, the Participant grants InvincibleYOU a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, aggregate, analyze, and report on such responses solely for assessment administration, organizational reporting, research, statistical analysis, service improvement, security, troubleshooting, and other lawful purposes described in the Privacy Policy. The processing of personal data remains subject to the Privacy Policy and applicable data protection law.

9. Third-Party Services and Integrations

The Platform relies on third-party infrastructure and service providers, including Supabase and Resend. The Participant acknowledges that portions of the Services may depend on systems outside InvincibleYOU’s direct control. InvincibleYOU is not responsible for interruptions or failures attributable solely to third-party infrastructure except where liability cannot legally be excluded.

10. Intellectual Property Rights

All intellectual property rights in the Platform, including its software, methodologies, assessment design, scoring algorithms, reports, branding, and documentation, remain the property of InvincibleYOU and/or its licensors. No ownership rights are transferred to Participants.

11. Privacy and Data Processing

Collection, processing, storage, retention, and disclosure of Participant information is governed by the InvincibleYOU DRIFT Assessment Privacy Policy and applicable data protection laws, including the Digital Personal Data Protection Act, 2023 and, where applicable, the GDPR.

12. Suspension and Termination of Access

InvincibleYOU may invalidate an Access Code, block a submission, or restrict access where violations of these Terms, fraud, duplicate submissions, unauthorized use, or security risks are identified, including without prior notice where reasonably necessary.

13. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind. InvincibleYOU does not warrant that the Services will be uninterrupted, error-free, or immune from technical failures.

14. Limitation of Liability

To the fullest extent permitted by applicable law, InvincibleYOU shall not be liable for indirect, incidental, consequential, or punitive damages, loss of data, or business interruption arising out of or relating to the Services. Nothing herein excludes liability where exclusion is prohibited by applicable law.

15. Indemnification

The Participant agrees to indemnify and hold harmless InvincibleYOU, its affiliates, officers, employees, and licensors against claims arising from the Participant’s breach of these Terms, unauthorized use of an Access Code, infringement of third-party rights, or unlawful conduct in connection with the Services.

16. International Data Transfers

The Participant acknowledges that information may be processed or stored across jurisdictions where InvincibleYOU or its infrastructure providers maintain facilities. Under the Digital Personal Data Protection Act, 2023, such transfers are permitted except to countries or territories notified as restricted by the Government of India. Where the GDPR applies, transfers are subject to Standard Contractual Clauses, adequacy decisions, or equivalent lawful safeguards, as applicable.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Courts having jurisdiction over the registered office of InvincibleYOU shall possess exclusive jurisdiction over disputes arising from or relating to these Terms, subject to any mandatory jurisdictional requirements under applicable law.

18. Modifications and Policy Updates

InvincibleYOU may amend these Terms to reflect legal, operational, or technological developments. Updated Terms become effective upon publication for non-consent matters. Where a change requires fresh consent under applicable law, the Company will obtain such consent through an appropriate mechanism.
